1. Nuestro compromiso
{{NOMBRE_APP}} (el "Servicio") es una plataforma donde el contenido lo crean y lo publican sus usuarios. No creamos ese contenido, no lo seleccionamos previamente y no verificamos la titularidad de los derechos antes de su publicación.
Respetamos los derechos de propiedad intelectual y exigimos lo mismo a nuestros usuarios. Retiramos con diligencia el contenido que se nos notifique como infractor y cerramos de forma definitiva, en circunstancias apropiadas, las cuentas de los usuarios que infringen de forma reiterada.
Esta Política describe cómo notificarnos una infracción, qué hacemos al recibir una notificación y cómo puede responder el usuario afectado. Forma parte de los Términos de Uso ({{DOMINIO}}/terminos).
2. Antes de enviarnos una notificación
2.1. Considera contactar primero al usuario. En la mayoría de los casos, escribir directamente a la persona que publicó el contenido resuelve el asunto con mucha más rapidez que un procedimiento formal. Puedes hacerlo desde su perfil en la App. Esto es una sugerencia práctica y no limita en absoluto tu derecho a presentarnos una notificación.
2.2. Verifica que eres la persona legitimada. Solo el titular de los derechos o su representante autorizado puede presentar una notificación. Si crees que un contenido infringe derechos de un tercero, puedes avisar a ese titular para que actúe.
2.3. Considera si existe una excepción legal. Usos como la crítica, la parodia, el comentario o la cita pueden estar amparados por la ley. Si tienes dudas, consulta con un profesional del derecho antes de enviar una notificación.
2.4. No arbitramos disputas. No estamos en condiciones de mediar ni de resolver controversias entre terceros sobre la titularidad de una obra. Actuamos conforme a esta Política y a la ley aplicable, y en ocasiones eso significa que no podremos retirar el contenido que nos señales.
3. Notificación de infracción de derechos de autor
Para que podamos actuar, tu notificación debe incluir todos los elementos siguientes, que son los que exige el artículo 512(c)(3) de la Digital Millennium Copyright Act (DMCA) de Estados Unidos:

Firma física o electrónica de la persona autorizada para actuar en nombre del titular del derecho presuntamente infringido. Se acepta el nombre legal completo escrito en el formulario.

Identificación de la obra protegida que consideras infringida. Si son varias obras del mismo titular, una lista representativa de ellas.

Identificación del material infractor y de su ubicación, con información razonablemente suficiente para que podamos localizarlo: el código del paquete, el enlace al paquete o al sticker, el nombre del paquete y, si la reclamación afecta solo a algunos stickers dentro de un paquete, la indicación exacta de cuáles.

Tus datos de contacto: nombre completo, dirección postal, número de teléfono y dirección de correo electrónico.

Declaración de buena fe de que crees de buena fe que el uso del material en la forma en que se ha publicado no está autorizado por el titular del derecho, su representante o la ley.

Declaración de exactitud, bajo pena de perjurio, de que la información contenida en la notificación es exacta y de que eres el titular del derecho presuntamente infringido o estás autorizado para actuar en su nombre.

Si falta alguno de los seis elementos, es posible que no podamos tramitar tu notificación y te pediremos que la completes.
4. Notificación de infracción de marca
4.1. No permitimos el uso no autorizado de una marca cuando pueda generar confusión, engaño o error sobre el origen, patrocinio o afiliación del contenido.
4.2. Los procedimientos del DMCA no se aplican a las marcas. Las reclamaciones de marca se tramitan por una vía propia, a través del mismo formulario de {{DOMINIO}}/reclamo, seleccionando la opción correspondiente.
4.3. Tu notificación de marca debe incluir: tus datos de contacto completos; la identificación de la marca, con su número de registro y jurisdicción si está registrada; los productos o servicios para los que está registrada; la identificación del contenido concreto que consideras infractor y su ubicación; la explicación de por qué el uso genera confusión; una declaración de buena fe; y tu firma.
4.4. Una marca no otorga un derecho exclusivo sobre una palabra en todos los contextos. Valoraremos si existe un riesgo real de confusión antes de retirar contenido.
5. Qué hacemos al recibir una notificación
5.1. Acuse de recibo. Confirmamos la recepción de forma inmediata y automática, con un número de referencia con el que puedes hacer seguimiento.
5.2. Revisión. Comprobamos que la notificación esté completa y que identifique de forma suficiente el contenido. Objetivo de respuesta: {{PLAZO_RESPUESTA, p. ej. 48 horas hábiles}} desde la recepción.
5.3. Retirada. Si la notificación es válida, retiramos o deshabilitamos el acceso al contenido con diligencia. El contenido deja de estar visible y de poder descargarse de inmediato.
5.4. Notificación al usuario. Informamos al usuario que publicó el contenido: qué se retiró, por qué, quién presentó la reclamación, y cómo puede responder mediante una contranotificación.
5.5. Prevención de reincidencia. Calculamos la huella digital (hash) del contenido retirado e impedimos que el mismo material vuelva a publicarse en el Servicio por cualquier usuario.
5.6. Registro de la falta. La retirada suma una falta a la cuenta del usuario, conforme a la sección 10 de los Términos de Uso.
5.7. Registro interno. Conservamos un registro de todas las notificaciones recibidas y de las medidas adoptadas, junto con una copia del material retirado, como evidencia y para atender contranotificaciones, apelaciones y requerimientos legales.
5.8. Comunicación de tus datos. Podemos entregar tu notificación completa, incluidos tus datos de contacto, al usuario cuyo contenido se retira, y a terceros como organizaciones de transparencia. Si te preocupa que se compartan tus datos personales, puedes facilitar datos profesionales o designar a un representante para que presente la reclamación en tu nombre.
6. Contranotificación por derechos de autor
Si tu contenido fue retirado y crees de buena fe que se retiró por error o por una identificación incorrecta del material, puedes enviarnos una contranotificación.
6.1. Tu contranotificación debe incluir todos los elementos siguientes, que son los que exige el artículo 512(g)(3) de la DMCA:

Tu firma física o electrónica.

Identificación del material retirado y del lugar donde aparecía antes de su retirada (código del paquete, nombre y enlace).

Declaración, bajo pena de perjurio, de que crees de buena fe que el material fue retirado o deshabilitado como consecuencia de un error o de una identificación incorrecta del material.

Tu nombre completo, dirección postal y número de teléfono.

Declaración de que aceptas la jurisdicción del tribunal federal del distrito judicial donde se encuentre tu domicilio, o, si tu domicilio está fuera de Estados Unidos, de cualquier distrito judicial en el que podamos ser localizados, y de que aceptarás la notificación de la demanda de la persona que presentó la notificación original o de su representante.

6.2. Qué ocurre después. Si la contranotificación es válida:
a) enviaremos una copia íntegra a quien presentó la notificación original, incluidos todos tus datos de contacto;
b) le informaremos de que restableceremos el material en un plazo de entre diez (10) y catorce (14) días hábiles;
c) si dentro de ese plazo no recibimos aviso de que ha interpuesto una acción judicial para impedir la publicación del material, lo restableceremos y anularemos la falta correspondiente;
d) si nos comunica que ha interpuesto la acción, el material permanecerá retirado hasta que se resuelva.
6.3. Advertencia. Una contranotificación es un documento legal con consecuencias reales: tus datos personales se entregarán a la parte contraria y aceptas expresamente la jurisdicción de un tribunal. Si no tienes certeza sobre tus derechos, consulta con un profesional del derecho antes de enviarla.
6.4. Marcas. Las reclamaciones de marca no cuentan con un procedimiento legal de contranotificación equivalente. Aun así, si tu contenido se retiró por una reclamación de marca y crees que fue un error, puedes exponerlo escribiendo a {{EMAIL_COPYRIGHT}} y lo revisaremos.
7. Política de infractores reincidentes
7.1. Cerramos de forma definitiva, en circunstancias apropiadas, las cuentas de los usuarios que infringen de forma reiterada derechos de propiedad intelectual de terceros.
7.2. Cada contenido retirado por una notificación válida suma una falta. A la tercera falta se cierra la cuenta de forma definitiva y se prohíbe la creación de cuentas nuevas. La escala completa está en la sección 10 de los Términos de Uso.
7.3. Cerramos la cuenta de inmediato, sin escala previa, cuando la infracción es masiva o sistemática, o cuando existan otros indicios claros de un patrón de reincidencia.
7.4. Una falta se anula si prospera una contranotificación, si el reclamante retira su notificación o si concluimos que la retirada fue incorrecta.

9. Notificaciones bajo el Reglamento de Servicios Digitales (Unión Europea)
9.1. Cualquier persona o entidad puede notificarnos la presencia de contenido que considere ilícito, tenga o no cuenta en el Servicio, a través de {{DOMINIO}}/reclamo o de {{EMAIL_COPYRIGHT}}.
9.2. Para que podamos tramitarla, la notificación debe contener: una explicación suficientemente motivada de por qué el contenido es ilícito; la ubicación exacta del contenido; el nombre y el correo electrónico de quien notifica, salvo que se refiera a determinados delitos contra las personas; y una declaración de que la información facilitada es exacta y completa de buena fe.
9.3. Enviamos acuse de recibo sin dilación indebida, tramitamos las notificaciones de forma diligente, no arbitraria y objetiva, y comunicamos nuestra decisión motivada tanto a quien notifica como al usuario afectado, informando de las vías de recurso disponibles, incluidas las judiciales y las de resolución extrajudicial de litigios.
9.4. Cuando el análisis incluya medios automatizados, lo indicaremos en la decisión.

10. Notificaciones falsas o abusivas
10.1. Presentar una notificación de infracción es un acto con consecuencias legales. Conforme al artículo 512(f) de la DMCA, quien tergiverse de forma consciente y sustancial que un material es infractor, o que fue retirado por error, puede responder por los daños causados, incluidos los honorarios de abogados.
10.2. Podemos rechazar notificaciones de quienes envíen reclamaciones fraudulentas o reiteradamente infundadas, y suspender su acceso a nuestros canales de reclamación. Si el remitente es usuario del Servicio, podemos cerrar su cuenta.
11. Otros derechos
Si el contenido que quieres reportar no afecta a derechos de autor ni a marcas, sino a tu derecho a la imagen, a tu privacidad o a tu honor, o constituye una suplantación de tu identidad, escríbenos a {{EMAIL_SOPORTE}} describiendo la situación y aportando la ubicación del contenido.
12. Contenido publicado por nosotros
Si el Servicio incluye contenido propio o licenciado, aparecerá identificado como tal. Las reclamaciones sobre ese contenido se dirigen directamente a {{EMAIL_COPYRIGHT}} y se tramitan por la misma vía descrita en esta Política.
13. Cambios en esta Política
Podemos actualizar esta Política. Publicaremos la nueva versión con su número y fecha de vigencia.

1. Our commitment
{{NOMBRE_APP}} (the "Service") is a platform where content is created and published by its users. We do not create that content, we do not curate it in advance, and we do not verify rights ownership before publication.
We respect intellectual property rights and require the same of our users. We expeditiously remove content that is reported to us as infringing, and in appropriate circumstances we permanently close the accounts of users who repeatedly infringe.
This Policy explains how to notify us of an infringement, what we do when we receive a notice, and how the affected user can respond. It forms part of the Terms of Use ({{DOMINIO}}/terms).
2. Before sending us a notice
2.1. Consider contacting the user first. In most cases, writing directly to the person who published the content resolves the matter far more quickly than a formal procedure. You can do so from their profile in the App. This is a practical suggestion and does not limit your right to send us a notice.
2.2. Confirm you are entitled to file. Only the rights holder or their authorized representative may submit a notice. If you believe content infringes a third party's rights, you may let that rights holder know so that they can act.
2.3. Consider whether a legal exception applies. Uses such as criticism, parody, commentary or quotation may be protected by law. If you are unsure, consult a legal professional before sending a notice.
2.4. We do not arbitrate disputes. We are not in a position to mediate or resolve disputes between third parties over the ownership of a work. We act in accordance with this Policy and applicable law, and on occasion that means we may not be able to remove the content you report.
3. Copyright infringement notice
For us to be able to act, your notice must include all of the following elements, which are those required by section 512(c)(3) of the United States Digital Millennium Copyright Act (DMCA):

A physical or electronic signature of the person authorized to act on behalf of the owner of the allegedly infringed right. Your full legal name typed into the form is accepted.

Identification of the copyrighted work you claim has been infringed. If multiple works by the same owner are involved, a representative list of them.

Identification of the infringing material and of its location, with information reasonably sufficient for us to locate it: the pack code, the link to the pack or sticker, the pack name and, if the claim concerns only some stickers within a pack, exactly which ones.

Your contact information: full name, postal address, telephone number and email address.
-
A statement of good faith belief that use of the material in the manner complained of is not authorized by the rights holder, its agent or the law.

A statement of accuracy, under penalty of perjury, that the information in the notice is accurate and that you are the owner of the allegedly infringed right or are authorized to act on their behalf.

If any of the six elements is missing, we may be unable to process your notice and will ask you to complete it.
4. Trademark infringement notice
4.1. We do not permit the unauthorized use of a trademark where it may cause confusion, deception or mistake as to the origin, sponsorship or affiliation of the content.
4.2. DMCA procedures do not apply to trademarks. Trademark claims are handled through their own route, using the same form at {{DOMINIO}}/claim and selecting the corresponding option.
4.3. Your trademark notice must include: your full contact information; identification of the trademark, with its registration number and jurisdiction if registered; the goods or services for which it is registered; identification of the specific content you consider infringing and its location; an explanation of why the use causes confusion; a statement of good faith belief; and your signature.
4.4. A trademark does not grant an exclusive right over a word in every context. We will assess whether there is a genuine likelihood of confusion before removing content.
5. What we do when we receive a notice
5.1. Acknowledgement. We confirm receipt immediately and automatically, with a reference number you can use to follow up.
5.2. Review. We check that the notice is complete and that it identifies the content sufficiently. Target response time: {{PLAZO_RESPUESTA, e.g. 48 business hours}} from receipt.
5.3. Removal. If the notice is valid, we expeditiously remove or disable access to the content. It immediately ceases to be visible or downloadable.
5.4. Notice to the user. We inform the user who published the content: what was removed, why, who submitted the claim, and how they may respond by counter-notice.
5.5. Preventing recurrence. We compute the hash of the removed content and prevent the same material from being published again on the Service by any user.
5.6. Strike recorded. The removal adds a strike to the user's account, in accordance with section 10 of the Terms of Use.
5.7. Internal record. We keep a record of all notices received and of the measures taken, together with a copy of the removed material, as evidence and in order to handle counter-notices, appeals and legal requests.
5.8. Sharing your information. We may provide your complete notice, including your contact details, to the user whose content is removed, and to third parties such as transparency organizations. If you are concerned about your personal information being shared, you may provide business or professional contact details, or appoint a representative to submit the claim on your behalf.
6. Copyright counter-notice
If your content was removed and you believe in good faith that it was removed as a result of a mistake or misidentification, you may send us a counter-notice.
6.1. Your counter-notice must include all of the following elements, which are those required by section 512(g)(3) of the DMCA:

Your physical or electronic signature.

Identification of the material that was removed and of the location at which it appeared before it was removed (pack code, name and link).

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

Your full name, postal address and telephone number.
-
A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, of any judicial district in which we may be found, and that you will accept service of process from the person who submitted the original notice or their agent.

6.2. What happens next. If the counter-notice is valid:
a) we will send a complete copy to the person who submitted the original notice, including all of your contact details;
b) we will inform them that we will restore the material in not less than ten (10) and not more than fourteen (14) business days;
c) if within that period we do not receive notice that they have filed a court action seeking to restrain the publication of the material, we will restore it and void the corresponding strike;
d) if they inform us that they have filed such an action, the material will remain removed pending resolution.
6.3. Warning. A counter-notice is a legal document with real consequences: your personal details will be handed to the opposing party and you expressly consent to the jurisdiction of a court. If you are not certain about your rights, consult a legal professional before sending one.
6.4. Trademarks. Trademark claims have no equivalent statutory counter-notice procedure. Even so, if your content was removed following a trademark claim and you believe this was a mistake, you may explain the position by writing to {{EMAIL_COPYRIGHT}} and we will review it.
7. Repeat infringer policy
7.1. In appropriate circumstances we permanently close the accounts of users who are repeat infringers of the intellectual property rights of others.
7.2. Each item of content removed following a valid notice adds one strike. On the third strike the account is permanently closed and the creation of new accounts is prohibited. The full scale is set out in section 10 of the Terms of Use.
7.3. We close the account immediately, without the graduated scale, where the infringement is bulk or systematic, or where there is other clear evidence of a pattern of repeat infringement.
7.4. A strike is voided if a counter-notice succeeds, if the claimant withdraws the notice, or if we conclude that the removal was incorrect.
8. Designated agent
We have designated the following agent with the United States Copyright Office to receive notifications of claimed copyright infringement:

9. Notices under the Digital Services Act (European Union)
9.1. Any individual or entity may notify us of the presence of content they consider illegal, whether or not they have an account on the Service, through {{DOMINIO}}/claim or {{EMAIL_COPYRIGHT}}.
9.2. For us to process it, the notice must contain: a sufficiently substantiated explanation of why the content is illegal; the exact location of the content; the name and email address of the person submitting it, except where it concerns certain offences against persons; and a statement that the information provided is accurate and complete to the best of their good-faith knowledge.
9.3. We acknowledge receipt without undue delay, process notices in a diligent, non-arbitrary and objective manner, and communicate our reasoned decision to both the notifying party and the affected user, informing them of the available redress mechanisms, including judicial remedies and out-of-court dispute settlement.
9.4. Where our assessment involves automated means, we will state this in the decision.

10. False or abusive notices
10.1. Submitting an infringement notice is an act with legal consequences. Under section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for the resulting damages, including attorneys' fees.
10.2. We may reject notices from parties who submit fraudulent or repeatedly unfounded claims, and suspend their access to our claim channels. Where the sender is a user of the Service, we may close their account.
11. Other rights
If the content you wish to report does not concern copyright or trademarks but rather your image rights, your privacy or your reputation, or constitutes impersonation of your identity, write to us at {{EMAIL_SOPORTE}} describing the situation and providing the location of the content.
12. Content published by us
Where the Service includes our own or licensed content, it will be identified as such. Claims regarding that content should be sent directly to {{EMAIL_COPYRIGHT}} and are handled through the same route described in this Policy.
13. Changes to this Policy
We may update this Policy. We will publish the new version with its version number and effective date.
