1. Quiénes somos y qué es este documento
{{NOMBRE_APP}} (el "Servicio" o la "App") es operado por {{TITULAR}}, con domicilio en {{DIRECCION_POSTAL}} ("nosotros", "nuestro").
El Servicio es una plataforma que permite a sus usuarios crear, publicar, buscar y descargar stickers y paquetes de stickers. El contenido que se publica en el Servicio lo crean y lo suben los propios usuarios. Nosotros proporcionamos las herramientas de creación y el alojamiento; no somos los autores de ese contenido y no lo revisamos previamente en su totalidad.
Estos Términos de Uso (los "Términos") son el contrato entre tú y nosotros. Forman parte del mismo acuerdo y se incorporan por referencia:

Si hay contradicción entre estos Términos y alguno de esos documentos, prevalece lo que sea más restrictivo respecto del contenido publicable.
2. Aceptación de los Términos
2.1. Al descargar, acceder o usar el Servicio, aceptas estos Términos y los documentos incorporados. Si no estás de acuerdo con alguna parte, no puedes usar el Servicio.
2.2. Aceptación previa a publicar. Antes de que puedas crear o publicar contenido por primera vez, te mostraremos estos Términos y las Directrices de Contenido y te pediremos una aceptación expresa. Registramos el identificador de tu cuenta, la versión aceptada y la fecha y hora de la aceptación. Sin esa aceptación no es posible publicar.
2.3. Si usas el Servicio en nombre de una empresa u otra entidad, declaras que tienes facultades para obligarla, y "tú" incluye a esa entidad.
3. Cambios en los Términos
3.1. Podemos modificar estos Términos. Toda versión publicada lleva número de versión y fecha de vigencia.
3.2. Si el cambio afecta de forma sustancial a tus derechos u obligaciones, te avisaremos dentro de la App o por correo electrónico con al menos treinta (30) días de antelación y te pediremos una nueva aceptación expresa antes de que puedas seguir publicando.
3.3. El uso del Servicio después de la fecha de vigencia de una nueva versión implica su aceptación. Si no aceptas la nueva versión, debes dejar de usar el Servicio y puedes eliminar tu cuenta.
4. Edad mínima y personas menores de edad
4.1. Para usar el Servicio debes tener al menos trece (13) años, o la edad mínima superior que exija la ley de tu país de residencia.
4.2. Si tienes entre la edad mínima y la mayoría de edad de tu país, solo puedes usar el Servicio con el consentimiento y bajo la supervisión de tu madre, padre o representante legal, quien debe haber leído y aceptado estos Términos. Podemos pedirte que acredites ese consentimiento.
4.3. El Servicio no está dirigido a menores de la edad mínima. Si detectamos o recibimos una notificación creíble de que una cuenta pertenece a alguien que no alcanza la edad mínima, la cerraremos y eliminaremos los datos asociados conforme a la Política de Privacidad.
4.4. El contenido que explote, sexualice o ponga en peligro a menores está absolutamente prohibido, sin excepciones y sin escala gradual de sanciones. Ver la sección 3 de las Directrices de Contenido.
5. Tu cuenta
5.1. Debes proporcionar información veraz al registrarte y mantenerla actualizada. Eres responsable de mantener la confidencialidad de tus credenciales y de toda la actividad que ocurra en tu cuenta.
5.2. Salvo que te autoricemos por escrito, una persona solo puede tener una cuenta.
5.3. Prohibición de reingreso. Si cerramos tu cuenta por infracción de estos Términos o de las Directrices de Contenido, no puedes crear otra cuenta, usar la cuenta de un tercero ni valerte de ningún otro medio para volver al Servicio. Podemos cerrar cualquier cuenta que identifiquemos como creada para eludir un cierre anterior.
5.4. Puedes eliminar tu cuenta en cualquier momento desde Ajustes dentro de la App, o solicitarlo en {{DOMINIO}}/eliminar-cuenta sin necesidad de reinstalar la App.
6. Tu contenido
6.1. Definición. "Contenido de Usuario" es todo lo que subas, crees o publiques a través del Servicio: stickers, paquetes de stickers, imágenes, nombres de paquete, descripciones, etiquetas, nombre de usuario, foto de perfil y cualquier otro material.
6.2. Tú conservas la propiedad. Los stickers y paquetes que creas con el Servicio son de la persona o entidad que los creó. No adquirimos ninguna titularidad sobre tu Contenido de Usuario.
6.3. Tus declaraciones y garantías. Cada vez que publicas Contenido de Usuario declaras y garantizas que:
a) eres el autor de ese contenido, o cuentas con la autorización expresa de todos los titulares de derechos para usarlo en el Servicio y en las condiciones de estos Términos;
b) no infringe derechos de autor, marcas registradas, diseños industriales, derechos de imagen, de voz, de nombre ni de privacidad de ninguna persona o entidad;
c) cumple las Directrices de Contenido y la ley aplicable;
d) no procede de la extracción, descarga, copia o importación de contenido de otras aplicaciones, servicios de mensajería, sitios web, bibliotecas o catálogos de terceros sin autorización de sus titulares;
e) si aparecen personas identificables, cuentas con su consentimiento o, en el caso de menores, con el de su representante legal.
6.4. Confirmación expresa. Antes de publicar cada paquete deberás marcar una casilla confirmando lo anterior. Esa confirmación se registra con fecha y hora. Eres el único responsable de tu Contenido de Usuario y de las consecuencias de publicarlo.
6.5. Licencia que nos otorgas. Al publicar Contenido de Usuario nos concedes una licencia no exclusiva, mundial, gratuita y sublicenciable únicamente a nuestros proveedores de infraestructura (alojamiento, red de distribución de contenidos, copias de seguridad), para:
a) alojar, almacenar, copiar y transmitir tu contenido;
b) convertirlo a los formatos y tamaños técnicos que el Servicio necesita, incluidas miniaturas y previsualizaciones;
c) mostrarlo, ponerlo a disposición y distribuirlo dentro del Servicio y en las funciones de exportación a aplicaciones de mensajería;
d) si lo publicaste como contenido público, mostrarlo en materiales de promoción del propio Servicio.
Esta licencia existe con la única finalidad de operar, mantener y promocionar el Servicio. No nos autoriza a vender tu contenido por separado, a licenciarlo a terceros fuera del Servicio ni a cederlo a otra empresa salvo en caso de transmisión del Servicio como unidad.
6.6. Duración de la licencia. La licencia se mantiene mientras el contenido esté publicado. Si lo eliminas o cierras tu cuenta, dejaremos de mostrarlo y de distribuirlo en un plazo razonable. Podemos conservar copias en sistemas de respaldo durante el ciclo normal de retención, y copias de contenido retirado por infracción conforme a la sección 9.4, sin mostrarlas públicamente. Los paquetes que otros usuarios ya hayan descargado a sus dispositivos o exportado a sus aplicaciones de mensajería antes de la eliminación pueden permanecer en esos dispositivos, fuera de nuestro control.
6.7. Licencia a otros usuarios. Cuando descargas contenido publicado por otro usuario, recibes una licencia limitada, personal, revocable, no exclusiva y no transferible para usarlo exclusivamente con fines personales y no comerciales. No puedes revenderlo, redistribuirlo, incorporarlo a otros productos ni reclamar su autoría.
6.8. Contenido público. Entiendes que el contenido que publiques como público podrá ser visto, buscado, descargado y exportado por cualquier usuario del Servicio.
6.9. No hay revisión previa. Podemos aplicar filtros automáticos y revisiones antes o después de la publicación. Esos filtros son una medida de seguridad, no una revisión editorial ni una aprobación: no verificamos la titularidad de los derechos ni el cumplimiento legal de cada contenido antes de publicarlo, y no asumimos obligación de hacerlo. La aparición de un contenido en secciones como "populares", "tendencias" o resultados de búsqueda responde a criterios automáticos de uso y actualidad, y no implica revisión, respaldo ni verificación por nuestra parte.
7. Contenido y conductas prohibidos
7.1. Las Directrices de Contenido ({{DOMINIO}}/directrices) definen qué contenido y qué conductas son objetables y están prohibidos en el Servicio. Forman parte de estos Términos y su incumplimiento es un incumplimiento de estos Términos.
7.2. Está prohibido, además:
a) usar robots, rastreadores, secuencias de comandos o cualquier medio automatizado para acceder al Servicio, extraer contenido o publicar de forma masiva;
b) descompilar, aplicar ingeniería inversa o intentar obtener el código fuente de la App;
c) eludir límites de uso, filtros de contenido, bloqueos o cierres de cuenta;
d) suplantar a otra persona, empresa o al propio Servicio;
e) vender, alquilar o transferir tu cuenta;
f) interferir con la seguridad o el funcionamiento del Servicio;
g) usar el Servicio para cualquier fin ilícito.
8. Reclamaciones de propiedad intelectual
8.1. Respetamos los derechos de propiedad intelectual y esperamos lo mismo de nuestros usuarios.
8.2. Cualquier titular de derechos o su representante autorizado puede notificarnos un contenido presuntamente infractor mediante el procedimiento descrito en la Política de Derechos de Autor y Marcas ({{DOMINIO}}/copyright). Ese canal es accesible sin necesidad de tener cuenta ni de iniciar sesión, tanto desde la web como desde la App.
8.3. Si eres titular de derechos y encuentras contenido tuyo publicado sin autorización, te sugerimos contactar primero al usuario que lo publicó: en muchos casos resuelve el asunto con más rapidez. Esto no limita en absoluto tu derecho a presentarnos una notificación formal.
9. Moderación, retirada de contenido y medidas sobre cuentas
9.1. Podemos, en cualquier momento y con o sin aviso previo: ocultar o retirar contenido, limitar su difusión, excluirlo de búsquedas y secciones de descubrimiento, restringir funciones de una cuenta, suspenderla temporalmente o cerrarla de forma definitiva.
9.2. Tomamos estas medidas cuando, a nuestro juicio razonable, concurre alguno de estos motivos: incumplimiento de estos Términos o de las Directrices de Contenido; notificación de un titular de derechos; requerimiento de una autoridad competente; riesgo legal, de seguridad o para la integridad del Servicio.
9.3. Notificación motivada. Cuando retiremos contenido tuyo o adoptemos una medida sobre tu cuenta, te informaremos indicando qué contenido se vio afectado, el motivo con referencia a la cláusula o directriz aplicable, si la decisión se tomó por medios automatizados y cómo puedes apelar. No enviaremos esa notificación cuando una ley o una autoridad nos lo impida, o cuando hacerlo pudiera obstaculizar una investigación.
9.4. Conservación como evidencia. Cuando retiremos contenido por una reclamación de derechos o por infracción grave, conservaremos una copia del archivo y de sus metadatos (identificador de la cuenta, fecha de subida, dirección IP, huella digital del archivo) durante {{PLAZO_CONSERVACION, p. ej. 12 meses}}, sin mostrarlos públicamente, con la finalidad de atender apelaciones, contranotificaciones, requerimientos legales y reclamaciones posteriores.
9.5. Huellas digitales. Podemos calcular huellas digitales (hashes) del contenido retirado e impedir que ese mismo contenido vuelva a publicarse en el Servicio por cualquier usuario.
10. Faltas y política de infractores reincidentes
10.1. En circunstancias apropiadas cerramos de forma definitiva las cuentas de los usuarios que infringen de forma reiterada los derechos de propiedad intelectual de terceros. Esta política se aplica de manera razonable y consistente.
10.2. Cada retirada de contenido tuyo por infracción de derechos de terceros, o por infracción de las Directrices de Contenido, suma una falta a tu cuenta.
10.3. Escala de medidas:

10.4. Infracciones graves. Las siguientes conductas dan lugar al cierre definitivo inmediato, sin escala previa: contenido que explote o sexualice a menores; contenido sexual explícito; amenazas creíbles de violencia; publicación masiva o sistemática de material infractor; suplantación con ánimo de engaño; y cualquier conducta que la ley tipifique como delito grave. Cuando corresponda, reportaremos el caso a las autoridades competentes.
10.5. Anulación de faltas. Una falta queda sin efecto si prospera tu apelación, si el reclamante retira su notificación, o si el contenido se restablece tras una contranotificación válida conforme a la Política de Derechos de Autor.
10.6. Caducidad. Las faltas caducan a los {{PLAZO_CADUCIDAD, p. ej. 12}} meses desde su imposición, siempre que no se hayan producido nuevas infracciones en ese período. Las infracciones graves de la sección 10.4 no caducan.
11. Apelaciones
11.1. Si retiramos contenido tuyo o adoptamos una medida sobre tu cuenta, puedes apelar durante los seis (6) meses siguientes a la notificación, usando el enlace incluido en ella o escribiendo a {{EMAIL_SOPORTE}}.
11.2. Revisaremos tu apelación de forma diligente y no discriminatoria. Cuando la decisión original se haya tomado por medios automatizados, la revisión la realizará una persona. Te comunicaremos el resultado de forma motivada, en un plazo orientativo de {{PLAZO_APELACION, p. ej. 14}} días hábiles.
11.3. Si eres titular de derechos y crees que hemos decidido incorrectamente sobre tu notificación, puedes apelar por la misma vía.
11.4. Las apelaciones sobre retiradas por derechos de autor están además sujetas al procedimiento de contranotificación descrito en la Política de Derechos de Autor y Marcas.
11.5. Estas vías no afectan a tu derecho de acudir a los tribunales ni, si resides en la Unión Europea, a los mecanismos de resolución extrajudicial de litigios previstos en la normativa aplicable.
12. Funciones de pago
12.1. Qué se vende. Las suscripciones y compras dentro de la App dan acceso a herramientas y funciones del Servicio, como la eliminación de publicidad, mayor capacidad de almacenamiento, funciones de edición adicionales, exportación en mayor calidad o paquetes privados. En ningún caso se vende, licencia ni condiciona el acceso a contenido concreto publicado por otros usuarios.
12.2. Sin incentivos por volumen. No remuneramos a los usuarios en función de la cantidad de contenido que publiquen ni ofrecemos recompensas que premien el volumen de publicaciones, para no incentivar conductas objetables.
12.3. Cobro. Los pagos se procesan a través de la tienda de aplicaciones correspondiente. Las suscripciones se renuevan automáticamente salvo cancelación, que debe hacerse en la propia tienda antes del fin del período en curso. Los reembolsos se rigen por la política de esa tienda.
12.4. La suspensión o el cierre de tu cuenta por incumplimiento de estos Términos no genera derecho a reembolso de importes ya pagados.
13. Nuestra propiedad intelectual
13.1. El Servicio, la App, su software, interfaces, diseño, bases de datos, marcas, logotipos y nombres comerciales son de nuestra titularidad o contamos con licencia sobre ellos, y están protegidos por la legislación aplicable.
13.2. Te concedemos una licencia limitada, personal, revocable, no exclusiva y no transferible para usar la App conforme a estos Términos. No se te transfiere ninguna otra titularidad ni derecho.
13.3. Estos Términos no te autorizan a usar nuestro nombre, marcas, logotipos ni nombres de dominio.
13.4. Si el Servicio incluye contenido propio o de socios con licencia, aparecerá identificado como tal. Ese contenido no es Contenido de Usuario y no está cubierto por las secciones 6.5 a 6.7.
14. Publicidad y servicios de terceros
14.1. El Servicio puede mostrar publicidad propia o de terceros. No respaldamos los productos o servicios anunciados.
14.2. El Servicio puede contener enlaces o integraciones con servicios de terceros, incluidas aplicaciones de mensajería. No controlamos esos servicios ni respondemos por ellos. Su uso se rige por sus propias condiciones y políticas de privacidad.
15. Privacidad
El tratamiento de tus datos personales se rige por nuestra Política de Privacidad ({{DOMINIO}}/privacidad), que forma parte de estos Términos.
16. Duración y terminación
16.1. Puedes dejar de usar el Servicio y eliminar tu cuenta en cualquier momento.
16.2. Podemos suspender o terminar tu acceso conforme a las secciones 9 y 10.
16.3. Podemos modificar, suspender o descontinuar el Servicio, en todo o en parte. Si lo descontinuamos de forma definitiva, haremos un esfuerzo razonable por avisarte con antelación y darte la oportunidad de recuperar tu contenido.
16.4. Sobreviven a la terminación las secciones 6.3, 6.6, 9.4, 13, 17, 18, 19, 20 y 21.
17. Ausencia de garantías
EL SERVICIO Y TODO EL CONTENIDO DISPONIBLE EN ÉL SE PROPORCIONAN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUIDAS LAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, EXACTITUD Y NO INFRACCIÓN. NO GARANTIZAMOS QUE EL SERVICIO SEA ININTERRUMPIDO, SEGURO O LIBRE DE ERRORES, NI QUE TODO EL CONTENIDO PUBLICADO POR LOS USUARIOS CUMPLA ESTOS TÉRMINOS.
Algunas jurisdicciones no permiten la exclusión de determinadas garantías; en ese caso, las exclusiones anteriores se aplicarán en la máxima medida permitida por la ley.
18. Limitación de responsabilidad
18.1. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, NO RESPONDEMOS POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, PUNITIVOS O CONSECUENCIALES, NI POR LUCRO CESANTE, PÉRDIDA DE DATOS O PÉRDIDA DE OPORTUNIDAD, DERIVADOS DEL USO O LA IMPOSIBILIDAD DE USO DEL SERVICIO.
18.2. RECONOCES EXPRESAMENTE QUE NO SOMOS RESPONSABLES DEL CONTENIDO PUBLICADO POR OTROS USUARIOS NI DE SU CONDUCTA, INCLUIDA LA CONDUCTA DIFAMATORIA, OFENSIVA O ILÍCITA DE TERCEROS, Y QUE EL RIESGO DERIVADO DE ELLO RECAE SOBRE TI.
18.3. NUESTRA RESPONSABILIDAD AGREGADA POR CUALQUIER RECLAMACIÓN RELACIONADA CON EL SERVICIO SE LIMITA AL MAYOR DE: (i) EL IMPORTE QUE NOS HAYAS PAGADO EN LOS DOCE (12) MESES ANTERIORES AL HECHO QUE ORIGINA LA RECLAMACIÓN, O (ii) CINCUENTA DÓLARES ESTADOUNIDENSES (USD 50).
18.4. Nada en estos Términos excluye o limita la responsabilidad que no pueda excluirse o limitarse conforme a la ley aplicable, ni los derechos que la normativa de consumo te reconozca con carácter imperativo.
19. Indemnidad
Aceptas mantenernos indemnes frente a cualquier reclamación, demanda, pérdida, responsabilidad, daño y gasto (incluidos honorarios razonables de abogados) que derive de: tu Contenido de Usuario, tu uso del Servicio, tu incumplimiento de estos Términos o de la ley, o la infracción de derechos de terceros por tu parte. Esto incluye expresamente las reclamaciones de terceros por infracción de derechos de autor, marcas o derechos de imagen relacionadas con contenido que hayas publicado.
20. Ley aplicable y jurisdicción
20.1. Estos Términos se rigen por las leyes de {{PAIS_JURISDICCION}}, sin aplicación de sus normas sobre conflicto de leyes.
20.2. Cualquier controversia se someterá a los tribunales de {{CIUDAD_JURISDICCION}}, {{PAIS_JURISDICCION}}. Nos reservamos el derecho de accionar ante los tribunales de tu lugar de residencia cuando la ley así lo exija.
20.3. Si resides en un país cuya normativa de consumo te otorgue el derecho a demandar ante los tribunales de tu domicilio o a la aplicación de su ley imperativa, ese derecho se mantiene intacto.
21. Disposiciones generales
21.1. Divisibilidad. Si una cláusula se declara inválida, el resto sigue en vigor.
21.2. No renuncia. El hecho de que no ejerzamos un derecho no supone renunciar a él.
21.3. Cesión. No puedes ceder estos Términos. Nosotros podemos cederlos en caso de fusión, adquisición o transmisión del Servicio, avisándote previamente.
21.4. Acuerdo íntegro. Estos Términos y los documentos incorporados constituyen el acuerdo completo entre las partes sobre el Servicio.
21.5. Idioma. Estos Términos se publican en español e inglés. {{CLAUSULA_IDIOMA: en caso de discrepancia, prevalece la versión en inglés / en español}}.
21.6. Notificaciones. Te enviaremos notificaciones dentro de la App o al correo asociado a tu cuenta. Puedes notificarnos a {{EMAIL_SOPORTE}}.

1. Who we are and what this document is
{{NOMBRE_APP}} (the "Service" or the "App") is operated by {{TITULAR}}, with its address at {{DIRECCION_POSTAL}} ("we", "us", "our").
The Service is a platform that allows its users to create, publish, search for and download stickers and sticker packs. The content published on the Service is created and uploaded by users themselves. We provide the creation tools and the hosting; we are not the authors of that content and we do not review all of it before publication.
These Terms of Use (the "Terms") are the agreement between you and us. The following documents are part of the same agreement and are incorporated by reference:

If these Terms conflict with any of those documents, the more restrictive provision regarding publishable content prevails.
2. Acceptance of the Terms
2.1. By downloading, accessing or using the Service, you accept these Terms and the documents incorporated into them. If you do not agree with any part of them, you may not use the Service.
2.2. Acceptance before publishing. Before you can create or publish content for the first time, we will show you these Terms and the Content Guidelines and ask for your express acceptance. We record your account identifier, the version accepted and the date and time of acceptance. Publishing is not possible without that acceptance.
2.3. If you use the Service on behalf of a company or another entity, you represent that you have authority to bind it, and "you" includes that entity.
3. Changes to the Terms
3.1. We may amend these Terms. Every published version carries a version number and an effective date.
3.2. If a change materially affects your rights or obligations, we will notify you in the App or by email at least thirty (30) days in advance and will ask for renewed express acceptance before you can continue publishing.
3.3. Using the Service after the effective date of a new version constitutes acceptance of it. If you do not accept the new version, you must stop using the Service and may delete your account.
4. Minimum age and minors
4.1. To use the Service you must be at least thirteen (13) years old, or the higher minimum age required by the law of your country of residence.
4.2. If you are between the minimum age and the age of majority in your country, you may only use the Service with the consent and under the supervision of a parent or legal guardian who has read and accepted these Terms. We may ask you to evidence that consent.
4.3. The Service is not directed to children below the minimum age. If we detect, or receive a credible report, that an account belongs to someone below the minimum age, we will close it and delete the associated data in accordance with the Privacy Policy.
4.4. Content that exploits, sexualizes or endangers minors is absolutely prohibited, without exception and without any graduated scale of penalties. See section 3 of the Content Guidelines.
5. Your account
5.1. You must provide accurate information when registering and keep it up to date. You are responsible for keeping your credentials confidential and for all activity that occurs on your account.
5.2. Unless we authorize you in writing, one person may hold only one account.
5.3. No re-registration. If we close your account for breach of these Terms or of the Content Guidelines, you may not create another account, use a third party's account, or use any other means to return to the Service. We may close any account we identify as having been created to circumvent a previous closure.
5.4. You may delete your account at any time from Settings within the App, or request deletion at {{DOMINIO}}/delete-account without having to reinstall the App.
6. Your content
6.1. Definition. "User Content" means everything you upload, create or publish through the Service: stickers, sticker packs, images, pack names, descriptions, tags, username, profile picture and any other material.
6.2. You keep ownership. Stickers and sticker packs created using the Service are owned by the person or entity that created them. We acquire no ownership of your User Content.
6.3. Your representations and warranties. Each time you publish User Content you represent and warrant that:
a) you are the author of that content, or you have express authorization from all rights holders to use it on the Service and on the terms set out here;
b) it does not infringe the copyright, trademarks, industrial designs, image, voice, name or privacy rights of any person or entity;
c) it complies with the Content Guidelines and with applicable law;
d) it does not come from scraping, downloading, copying or importing content from other applications, messaging services, websites, third-party libraries or commercial catalogues without authorization from the rights holders;
e) if identifiable people appear in it, you have their consent or, in the case of minors, that of their legal guardian.
6.4. Express confirmation. Before publishing each pack you must tick a box confirming the above. That confirmation is recorded with a timestamp. You are solely responsible for your User Content and for the consequences of publishing it.
6.5. The license you grant us. By publishing User Content you grant us a non-exclusive, worldwide, royalty-free license, sublicensable only to our infrastructure providers (hosting, content delivery network, backups), to:
a) host, store, copy and transmit your content;
b) convert it into the technical formats and sizes the Service requires, including thumbnails and previews;
c) display, make available and distribute it within the Service and through the export features to messaging applications;
d) if you published it as public content, display it in materials promoting the Service itself.
This license exists for the sole purpose of operating, maintaining and promoting the Service. It does not authorize us to sell your content separately, to license it to third parties outside the Service, or to assign it to another company except as part of a transfer of the Service as a whole.
6.6. Duration of the license. The license lasts for as long as the content remains published. If you delete it or close your account, we will stop displaying and distributing it within a reasonable period. We may retain copies in backup systems during the ordinary retention cycle, and copies of content removed for infringement in accordance with section 9.4, none of which are displayed publicly. Packs that other users have already downloaded to their devices or exported to their messaging applications before deletion may remain on those devices, beyond our control.
6.7. License to other users. When you download content published by another user, you receive a limited, personal, revocable, non-exclusive and non-transferable license to use it solely for personal, non-commercial purposes. You may not resell it, redistribute it, incorporate it into other products or claim authorship of it.
6.8. Public content. You understand that content you publish as public may be viewed, searched, downloaded and exported by any user of the Service.
6.9. No prior review. We may apply automated filters and reviews before or after publication. Those filters are a safety measure, not an editorial review or an approval: we do not verify rights ownership or the legal compliance of each item of content before publishing it, and we assume no obligation to do so. The appearance of content in sections such as "popular", "trending" or search results reflects automated criteria of usage and recency, and does not imply review, endorsement or verification by us.
7. Prohibited content and conduct
7.1. The Content Guidelines ({{DOMINIO}}/guidelines) define what content and conduct are objectionable and prohibited on the Service. They form part of these Terms and breaching them is a breach of these Terms.
7.2. It is also prohibited to:
a) use robots, crawlers, scripts or any automated means to access the Service, extract content or publish in bulk;
b) decompile, reverse engineer or attempt to obtain the source code of the App;
c) circumvent usage limits, content filters, blocks or account closures;
d) impersonate another person, business or the Service itself;
e) sell, rent or transfer your account;
f) interfere with the security or operation of the Service;
g) use the Service for any unlawful purpose.
8. Intellectual property claims
8.1. We respect intellectual property rights and expect our users to do the same.
8.2. Any rights holder or their authorized representative may notify us of allegedly infringing content using the procedure described in the Copyright and Trademark Policy ({{DOMINIO}}/copyright). That channel is accessible without an account and without signing in, both on the web and in the App.
8.3. If you are a rights holder and find your content published without authorization, we suggest contacting the user who posted it first: in many cases this resolves the matter more quickly. This does not limit in any way your right to submit a formal notice to us.
9. Moderation, content removal and account measures
9.1. We may, at any time and with or without prior notice: hide or remove content, limit its distribution, exclude it from search and discovery sections, restrict account features, suspend an account temporarily or close it permanently.
9.2. We take these measures where, in our reasonable judgement, any of the following applies: breach of these Terms or of the Content Guidelines; notice from a rights holder; a request from a competent authority; or a legal, safety or service-integrity risk.
9.3. Statement of reasons. When we remove your content or take a measure against your account, we will inform you of the content affected, the reason with reference to the applicable clause or guideline, whether the decision was taken by automated means, and how you can appeal. We will not send that notice where a law or an authority prevents us from doing so, or where doing so could obstruct an investigation.
9.4. Retention as evidence. Where we remove content following a rights claim or a serious breach, we will retain a copy of the file and its metadata (account identifier, upload date, IP address, file hash) for {{PLAZO_CONSERVACION, e.g. 12 months}}, without displaying them publicly, in order to handle appeals, counter-notices, legal requests and subsequent claims.
9.5. Hashes. We may compute hashes of removed content and prevent that same content from being published again on the Service by any user.
10. Strikes and repeat infringer policy
10.1. In appropriate circumstances we permanently close the accounts of users who repeatedly infringe the intellectual property rights of others. This policy is implemented reasonably and consistently.
10.2. Each removal of your content for infringing third-party rights, or for breaching the Content Guidelines, adds one strike to your account.
10.3. Scale of measures:

10.4. Serious violations. The following result in immediate permanent closure without the graduated scale: content that exploits or sexualizes minors; sexually explicit content; credible threats of violence; bulk or systematic publication of infringing material; impersonation with intent to deceive; and any conduct classified as a serious criminal offence. Where appropriate, we will report the matter to the competent authorities.
10.5. Strike removal. A strike is voided if your appeal succeeds, if the claimant withdraws the notice, or if the content is restored following a valid counter-notice under the Copyright and Trademark Policy.
10.6. Expiry. Strikes expire {{PLAZO_CADUCIDAD, e.g. 12}} months after they are issued, provided no further breaches have occurred in that period. The serious violations in section 10.4 do not expire.
11. Appeals
11.1. If we remove your content or take a measure against your account, you may appeal within six (6) months of the notice, using the link included in it or by writing to {{EMAIL_SOPORTE}}.
11.2. We will review your appeal diligently and in a non-discriminatory manner. Where the original decision was taken by automated means, the review will be carried out by a person. We will communicate the outcome with a statement of reasons, within an indicative period of {{PLAZO_APELACION, e.g. 14}} business days.
11.3. If you are a rights holder and believe we decided your notice incorrectly, you may appeal through the same channel.
11.4. Appeals concerning copyright removals are additionally subject to the counter-notice procedure described in the Copyright and Trademark Policy.
11.5. These channels do not affect your right to go to court or, if you reside in the European Union, to use the out-of-court dispute settlement mechanisms provided for under applicable law.
12. Paid features
12.1. What is sold. Subscriptions and in-app purchases give access to tools and features of the Service, such as ad removal, greater storage capacity, additional editing features, higher-quality export or private packs. Under no circumstances do we sell, license or condition access to specific content published by other users.
12.2. No volume incentives. We do not pay users based on how much content they publish, nor do we offer rewards that reward publishing volume, so that monetization does not incentivize objectionable behavior.
12.3. Billing. Payments are processed through the relevant app store. Subscriptions renew automatically unless cancelled, and cancellation must be made in the store itself before the end of the current period. Refunds are governed by that store's policy.
12.4. Suspension or closure of your account for breach of these Terms does not entitle you to a refund of amounts already paid.
13. Our intellectual property
13.1. The Service, the App, its software, interfaces, design, databases, trademarks, logos and trade names are owned by us or licensed to us, and are protected by applicable law.
13.2. We grant you a limited, personal, revocable, non-exclusive and non-transferable license to use the App in accordance with these Terms. No other title or right is transferred to you.
13.3. These Terms do not authorize you to use our name, trademarks, logos or domain names.
13.4. Where the Service includes our own content or licensed partner content, it will be identified as such. That content is not User Content and is not covered by sections 6.5 to 6.7.
14. Advertising and third-party services
14.1. The Service may display our own advertising or that of third parties. We do not endorse the products or services advertised.
14.2. The Service may contain links to or integrations with third-party services, including messaging applications. We do not control those services and are not responsible for them. Their use is governed by their own terms and privacy policies.
15. Privacy
The processing of your personal data is governed by our Privacy Policy ({{DOMINIO}}/privacy), which forms part of these Terms.
16. Term and termination
16.1. You may stop using the Service and delete your account at any time.
16.2. We may suspend or terminate your access in accordance with sections 9 and 10.
16.3. We may modify, suspend or discontinue the Service in whole or in part. If we discontinue it permanently, we will make reasonable efforts to give you advance notice and an opportunity to retrieve your content.
16.4. Sections 6.3, 6.6, 9.4, 13, 17, 18, 19, 20 and 21 survive termination.
17. Disclaimer of warranties
THE SERVICE AND ALL CONTENT AVAILABLE ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ALL CONTENT PUBLISHED BY USERS COMPLIES WITH THESE TERMS.
Some jurisdictions do not allow the exclusion of certain warranties; in those cases the above exclusions apply to the maximum extent permitted by law.
18. Limitation of liability
18.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, NOR FOR LOSS OF PROFITS, LOSS OF DATA OR LOSS OF OPPORTUNITY, ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICE.
18.2. YOU EXPRESSLY ACKNOWLEDGE THAT WE ARE NOT RESPONSIBLE FOR CONTENT PUBLISHED BY OTHER USERS OR FOR THEIR CONDUCT, INCLUDING THE DEFAMATORY, OFFENSIVE OR UNLAWFUL CONDUCT OF THIRD PARTIES, AND THAT THE RISK ARISING FROM IT RESTS WITH YOU.
18.3. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF: (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (ii) FIFTY UNITED STATES DOLLARS (USD 50).
18.4. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, nor any mandatory consumer rights you may have.
19. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss, liability, damage and expense (including reasonable attorneys' fees) arising from: your User Content, your use of the Service, your breach of these Terms or of the law, or your infringement of third-party rights. This expressly includes third-party claims for infringement of copyright, trademarks or image rights relating to content you have published.
20. Governing law and jurisdiction
20.1. These Terms are governed by the laws of {{PAIS_JURISDICCION}}, without regard to its conflict-of-law rules.
20.2. Any dispute shall be submitted to the courts of {{CIUDAD_JURISDICCION}}, {{PAIS_JURISDICCION}}. We reserve the right to bring proceedings before the courts of your place of residence where the law so requires.
20.3. If you reside in a country whose consumer legislation grants you the right to sue in the courts of your domicile or to the application of its mandatory law, that right remains unaffected.
21. General provisions
21.1. Severability. If any clause is held invalid, the remainder stays in force.
21.2. No waiver. Our failure to exercise a right does not constitute a waiver of it.
21.3. Assignment. You may not assign these Terms. We may assign them in the event of a merger, acquisition or transfer of the Service, with prior notice to you.
21.4. Entire agreement. These Terms and the documents incorporated into them constitute the entire agreement between the parties regarding the Service.
21.5. Language. These Terms are published in Spanish and English. {{CLAUSULA_IDIOMA: in the event of any discrepancy, the English version prevails / the Spanish version prevails}}.
